The What About Mkt name, brand identity, logos, visual elements, and all associated trademarks are the exclusive property of What About Mkt and are duly registered with the Instituto Nacional da Propriedade Industrial (INPI) in Brazil. All content published on our platform, including texts, articles, studies, graphics, designs, layouts, images, and any proprietary materials, is protected by applicable intellectual property laws.

Any unauthorized use, reproduction, imitation, distribution, modification, or attempt to copy or plagiarize our brand, content, or registered assets is strictly prohibited. Such violations constitute an infringement of intellectual property rights and will be subject to appropriate legal action. What About Mkt reserves the right to pursue all available measures under Brazilian law, including civil and criminal proceedings, to protect its intellectual property and seek compensation for damages.

By accessing our website and using our services, you agree to respect all intellectual property rights owned or licensed by What About Mkt and acknowledge that any misuse may result in immediate legal action without prior notice.

2. User Agreement

By accessing or using our website, you agree to these Terms of Use, including our Privacy Policy. You must be at least 18 years old or have the consent of a parent or guardian to use this site.

2.1 Account Security and Prohibition of Account Sharing

User accounts on the What About Mkt platform are intended for individual use only and may not be shared with other individuals, organizations, or third parties.

By creating an account, you agree to maintain the confidentiality of your login credentials, including your username and password, and you accept responsibility for all activities that occur under your account.

The sharing, transfer, resale, sublicensing, or distribution of account access credentials is strictly prohibited. This includes, but is not limited to:

  • Allowing multiple individuals to access the platform through a single account.
  • Sharing login credentials within organizations, teams, or groups.
  • Selling or distributing access to paid content or membership features.

What About Mkt reserves the right to monitor account usage patterns in order to detect unusual or abusive access behavior, including simultaneous logins, excessive device usage, or other indicators of account sharing.

If we reasonably determine that an account is being shared, transferred, or used in violation of these Terms, we reserve the right to take appropriate actions, which may include:

  • Temporary suspension of the account.
  • Restriction of access to certain platform features.
  • Termination of the account without refund.

Users are responsible for maintaining the security of their account credentials and must notify What About Mkt immediately if they suspect unauthorized access or misuse of their account.

2.2 Platform Integrity and Prohibited Use

Users agree to use the What About Mkt Website and services only for lawful purposes and in accordance with these Terms of Use. Any use of the platform that interferes with its normal operation, security, or intended functionality is strictly prohibited.

Users must not engage in activities that attempt to manipulate, disrupt, exploit, or gain unauthorized advantage from the platform or its systems. Prohibited activities include, but are not limited to:

  • Attempting to bypass subscription paywalls, membership restrictions, token limitations, or other access control mechanisms implemented by the platform.
  • Using automated tools, bots, scripts, scraping technologies, or similar mechanisms to access, collect, or interact with platform content, AI tools, or system features in a manner not authorized by What About Mkt.
  • Attempting to reverse engineer, probe, scan, test vulnerabilities, or otherwise compromise the security or performance of the Website or its underlying systems.
  • Excessive or abusive use of the AI assistance feature that may overload system resources or attempt to manipulate token usage or AI responses.
  • Using the platform in any way that may damage, disable, overburden, or impair the functioning of the Website or interfere with other users’ ability to access the services.

What About Mkt reserves the right to monitor usage patterns and system interactions in order to maintain the integrity, security, and performance of the platform.

If we determine, in our reasonable discretion, that a user has engaged in activities that threaten the integrity or proper functioning of the Website, we may take appropriate actions, including but not limited to:

  • Restricting or limiting access to certain features.
  • Suspending or terminating the user account.
  • Blocking access to the platform from specific devices, IP addresses, or networks.
  • Pursuing legal remedies when necessary to protect the platform, its content, and its users.

These measures may be taken without prior notice when necessary to protect the security, stability, or legal compliance of the What About Mkt platform.

3. Intellectual Property

All content on What About Mkt, including articles, logos, graphics, and other materials, is the intellectual Property of What About Mkt and is protected by copyright, trademark, and other applicable laws. You may not reproduce, distribute, or create derivative works from our content without our explicit permission.

3.1 Restrictions on Automated Content Extraction and AI Training

The content published on the What About Mkt platform, including but not limited to articles, studies, reports, editorial analysis, magazines, visual materials, data compilations, and proprietary research, is protected by intellectual property laws and constitutes original editorial work produced or licensed by What About Mkt.

Users are strictly prohibited from using automated systems, bots, scrapers, spiders, crawlers, artificial intelligence tools, or other data-extraction technologies to access, collect, reproduce, download, copy, summarize, or distribute content from the Website without the prior written authorization of What About Mkt.

This restriction specifically includes, but is not limited to:

  • The use of platform content to train, fine-tune, evaluate, or develop artificial intelligence systems, machine learning models, or large language models.
  • The automated extraction, indexing, or harvesting of articles, reports, magazines, or analytical materials for dataset creation or redistribution.
  • The use of automated tools or AI systems to generate derivative works, summaries, or compilations based on substantial portions of the Website’s content.

Any unauthorized automated access, data extraction, or use of the Website’s content for AI training, dataset development, or similar technological purposes may constitute a violation of intellectual property rights, contractual obligations under these Terms of Use, and applicable Brazilian and international laws.

What About Mkt reserves the right to implement technical measures designed to detect and prevent automated access to the Website and to pursue all available legal remedies against individuals or entities that engage in unauthorized extraction, reproduction, or exploitation of the platform’s content.

4. Products and Membership Plans.

The What About Mkt offers a range of products designed to keep users informed about the latest marketing trends, strategies, and insights. Our offerings include:

  • News Articles: Daily marketing updates available for online reading. These provide insights into industry trends, major brand moves, and strategic shifts in the marketing landscape.
  • Essential Magazines: A collection of curated marketing content, available for one-time purchase. Each issue provides in-depth coverage of major industry topics and is accessible online only.
  • Studies and Analysis: Downloadable reports offering deep dives into specific marketing strategies, consumer behavior trends, and case studies to help professionals make data-driven decisions.
  • Newsletter/Key Emails: Free email updates that provide bite-sized insights into key marketing developments. Users can select their preferred topics during sign-up and modify their preferences at any time from their account profile page.

4.1 Membership Plans

The What About Mkt offers two membership plans:

  • Basic Membership: Includes access to daily articles on the site, named as “News Articles”. 
  • Premium Membership: Grants access to all content on the site, including all the basic content, the “Essential Magazines”, and all the “Studies and Analysis”. 

For all users, the pricing structure is as follows:

  • Basic Membership: US$14.90 monthly while the subscription is active.
  • Premium Membership: US$24.90 monthly while the subscription is active.

Please note that prices may be changed from time to time, including due to promotions, commercial campaigns, or pricing updates. Any changes will be communicated in accordance with these terms.

4.2 Additional Membership Terms

  • Full Access: You’ll have full Access to all the features included in your selected package for 30 days.
  • Reminder Notification: We’ll send you a reminder email 5 days after your free trial start, letting you know about your upcoming payment.
  • Automatic Renewal: Your membership will automatically renew each month at the price stated in these terms.
  • Cancellation Policy: You can cancel at any time. If you do, your membership will stay active until the end of your current period, but won’t renew afterward.

4.3 Free Trial Program

We offer a 7-day free trial (“Free Trial”) facilitated by WooCommerce and WooSubscriptions for membership plans available on our website. By activating the Free Trial, you agree to the following terms:

  • Eligibility and Limitation: The Free Trial grants you full access to the selected membership plan for 7 days without payment. This is a one-time benefit; the user can only use this free trial once per account.
  • Data Retention Acknowledgment: By utilizing this feature, you acknowledge and agree that we retain the checkout information provided during the sign-up process (including payment details), even within the trial period. This data is stored to facilitate future transactions and ensure seamless service continuity.
  • Automatic Renewal After Trial: Unless you cancel before the end of the 7-day trial period, your membership will automatically renew at the price applicable to the selected plan.
  • Cancellation During Trial: You may cancel your Free Trial at any time during the 7-day period directly through the “Your Membership” section on your profile page. If canceled within the trial period, you will not be charged.

5. Subscription Changes, Upgrades, and Crossgrades

Subscribers may switch between available membership plans at any time by upgrading or crossgrading their active subscription through their account settings.

When a user changes their subscription plan, the platform applies an automated proration system designed to account for the remaining value of the current billing period. Depending on whether the user upgrades or crossgrades their plan, the system may adjust the payment amount due at checkout or modify the next billing date.

5.1 Upgrades

An upgrade occurs when a user switches to a plan with a higher price or greater level of access. In such cases, the system may charge a gap payment to account for the difference in value between the current subscription and the upgraded plan for the remaining days in the billing cycle.

The gap payment is calculated based on the difference between the daily price of the new subscription and the daily price of the existing subscription, multiplied by the number of days remaining until the next scheduled billing date. This amount may be charged immediately when the upgrade is confirmed.

After the upgrade is processed, the subscription continues under the new plan and the next renewal date typically remains the same unless the billing cycle of the new subscription requires a different renewal schedule.

5.2 Crossgrades During Trial Periods

A crossgrade occurs when a subscriber changes to another membership plan while still within an active free trial period.

Because a free trial provides temporary access without payment, switching to another plan during this period is treated as a voluntary change of subscription rather than a continuation of the trial. As a result, the remaining portion of the trial period is forfeited when the crossgrade is confirmed.

In such cases, the new subscription plan becomes active immediately and the applicable subscription fee for the selected plan may be charged at the time of the change. By proceeding with a plan change during a trial period, the subscriber acknowledges and agrees that the trial period will end and that the new subscription will begin according to the pricing and billing terms of the selected plan.

Free trial periods are tied to the specific subscription plan originally activated and cannot be transferred, extended, or reused when switching between plans. Any attempt to change plans during a trial period will result in the immediate termination of the trial and activation of the selected paid subscription.

6. Content Insights

6.1 Editorial and Research Use of Platform Data

What About Mkt may analyze information derived from user interactions with the platform in order to improve the quality, relevance, and depth of the content published on the Website.

This may include the analysis of aggregated or anonymized data related to user engagement with articles, studies, reports, magazines, newsletters, and other platform features. Such analysis may be used to identify trends, understand audience interests, and support the creation of new editorial materials.

Insights derived from these analyses may contribute to the development of articles, analytical reports, research studies, editorial insights, and other informational content published on the Website.

All such use of platform interaction data will be conducted in accordance with our Privacy Policy and Cookie Policy, and any information used for editorial or research purposes will be processed in aggregated or anonymized form so that individual users cannot be personally identified.

By using the Website and its services, you acknowledge and agree that anonymized or aggregated insights derived from platform usage may be utilized to inform editorial content, research publications, and analytical materials produced by What About Mkt.

7. Multi-Currency Payments

We offer a multi-currency payment system that enables users to transact in their preferred currency.

  • Automatic Currency Detection: Our system can detect your native currency based on your country or language settings, displaying prices accordingly.
  • Manual Currency Selection: Alternatively, you can choose from the following currencies: USD, ARS, AUD, BTC, BRL, CAD, CHF, CLP, EUR, GBP, NZD, UYU.

This functionality is powered by the WooCommerce Multi-Currency plugin, which ensures accurate and up-to-date exchange rates. The plugin automatically updates exchange rates at regular intervals, based on their rules.

7.1 Payment Processing and Currency Conversion

Payments are processed through Stripe, which supports over 135 currencies. When a payment is made in a currency different from our default currency, Stripe handles the conversion using the current exchange rates provided by their service providers. The currency conversion rate will determine the value of the renewal at the time of your first payment and will remain the same for all subsequent renewals. Please note that currency conversions may incur additional fees, including a conversion fee applied by the Multi-Currency plugin.

Important Note: While USD is the default currency displayed on the website, the default currency on our Stripe account is BRL (Brazilian Real). As a result, all transactions made in other currencies will be converted to BRL before being settled in our Stripe account, which may incur currency conversion fees, depending on the payment method and user’s location.

By offering multi-currency support, we aim to provide a seamless and convenient experience for our global user base.

7.2 Payment Failure and Retry Process

If an automatic subscription renewal payment fails due to insufficient funds, expired payment methods, authorization errors, or other payment processing issues, What About Mkt uses an automated payment retry system designed to attempt the renewal payment multiple times before the subscription is considered failed.

The platform may attempt to process the payment up to five (5) times over a period of approximately seven (7) days, following the retry schedule implemented by our subscription management system.

The retry schedule may occur as follows:

  • Retry Attempt 1: Approximately 12 hours after the initial failed payment attempt.
  • Retry Attempt 2: Approximately 12 hours after the first retry attempt.
  • Retry Attempt 3: Approximately 24 hours after the second retry attempt.
  • Retry Attempt 4: Approximately 48 hours after the third retry attempt.
  • Retry Attempt 5: Approximately 72 hours after the fourth retry attempt.

During this period, the subscription may temporarily be placed in an “On-hold” status, and the related renewal order may remain in “Pending” status until payment is successfully processed.

To help resolve payment issues, What About Mkt may send automated notification emails informing the user that a payment attempt has failed and requesting that the user review or update their payment information. These emails may include reminders about upcoming retry attempts and instructions on how to update billing details through the user’s account dashboard.

If all retry attempts are unsuccessful, the renewal order will be marked as “Failed”, and the subscription may remain suspended or inactive until the user manually completes the payment or updates their payment method.

During the retry period, users may experience limited or suspended access to subscription content and services depending on the platform’s billing status rules. What About Mkt reserves the right to restrict or restore access to paid features while payment retries are pending.

If a payment retry is successfully completed during this period, the subscription will be restored and the corresponding renewal period will continue according to the original subscription billing cycle.

Users are responsible for ensuring that their billing information remains accurate and up to date in order to avoid service interruptions or failed renewal attempts.

7.3 Payment Method Authorization

By subscribing to a membership plan or purchasing a recurring service on the What About Mkt platform, you authorize What About Mkt and its payment processors, including Stripe, to automatically charge the payment method provided at checkout for all applicable subscription renewals and related fees.

This authorization includes permission to perform recurring billing transactions, as well as any necessary pre-authorizations or verification requests required by payment processors to confirm that the payment method is valid and capable of supporting the transaction.

If your payment method expires, becomes invalid, or cannot be processed for any reason, you agree to update your billing information promptly through your account profile page dashboard. What About Mkt may continue to attempt renewal charges using the most recent valid payment method associated with your account until the subscription is canceled in accordance with these Terms.

You acknowledge that payment processors and financial institutions may perform additional security checks or authorization procedures in order to approve recurring transactions. These processes are controlled by the respective payment providers and financial networks, and What About Mkt is not responsible for delays or rejections resulting from such verification procedures.

By completing a purchase or activating a subscription, you confirm that you are authorized to use the selected payment method and that you grant permission for recurring charges in accordance with the billing terms described in these Terms of Use.

8. Automatic Messages and Notifications

Users may receive automated messages within the website or via email to enhance their experience. These may include:

  • Welcome Emails: Sent upon successful registration.
  • Purchase Emails: Including invoices and product updates.
  • “Payment Issue Detected” Notification: If a payment fails due to credit card errors or an incompatibility between the selected payment method and the user-provided information, a notification will be sent.
  • Promotional Emails: Sent periodically to inform users about special offers and content updates.
  • Authentication Emails: Sent for security purposes, such as verifying account changes or logging in from a new device. Users can manage their email preferences through the account profile page.
  • Renewal Reminder Emails: Sent to inform you about upcoming renewals of your membership plans or the end of a free trial period, as part of our risk-free program. These emails are sent via third-party providers (such as Mailchimp), and minor delivery delays may occur.

9. Cancellation Policy

To cancel automatic renewals, cancellation can be submitted at any time, however, to avoid the next charge, it must be completed at least 48 hours before renewal. You can cancel through your account dashboard at any time, just login in your account and access the “Your Membership” section in your profile. No refunds are issued for prior subscription periods.

9.1 Free Trial Abuse

The Free Trial program is intended for legitimate evaluation of the services offered by What About Mkt. Creating multiple accounts, manipulating account information, or using technical methods to repeatedly access the Free Trial is strictly prohibited.

What About Mkt reserves the right to suspend accounts, cancel trials, or restrict access to services in cases of suspected abuse of promotional programs.

10. User Content

10.1 Users may submit content for publication. Doing so grants What About Mkt a perpetual, non-exclusive, worldwide license to use, modify, and publish your content. We reserve the right to edit, remove, or refuse to publish any content at our discretion.

10.2 You are responsible for the content you submit. You must ensure that you own or have the necessary permission to use the content and that it does not infringe upon any third-party rights or laws.

10.3 Respectful communication is required, and hate speech or abusive behavior will not be tolerated. Violation of these guidelines can result in suspension or banning from the site.

11. Comments Policy

We encourage open discussions but require users to adhere to respectful communication guidelines. Hate speech, personal attacks, and abusive language are prohibited and may result in immediate suspension of Access to our services.

12. Indemnification

You agree to defend, indemnify, and hold What About Mkt harmless from any claims or liabilities arising from your use of the website, breach of these Terms, or any violation of rights by your submitted content.

13. Disclaimers

The website is provided “as is” without warranties. The What About Mkt does not guarantee the accuracy, completeness, or reliability of any content on the site, including content from third parties. Use of the site is at your own risk.

14. Governing Law

This agreement is governed by:

Brazilian Law: Including LGPD and Consumer Protection Code.

If you access or use our website from outside Brazil, you do so at your own initiative and are solely responsible for complying with any local laws that may apply in your jurisdiction. We do not guarantee that the content or services available on this website are appropriate or lawful outside Brazil.

15. Close Account / Delete Account

You may close or delete your account at any time directly through your profile page. Once your account is closed, your login access will be permanently disabled, and you will no longer be able to access any purchased or saved content associated with that account.

Upon account closure, the personal data you have provided will be handled, stored, or deleted in accordance with our Privacy Policy and all applicable Brazilian laws, including the LGPD. Certain information may be retained when required to comply with legal, contractual, financial, fraud-prevention, or security obligations, as described in our Privacy Policy.

Closing or deleting your account does not generate refunds for previous payments or subscription periods and does not automatically cancel ongoing memberships. If you wish to prevent future charges, you must cancel your membership before deleting your account.

16. Use of Cookies and Tracking Technologies

Our website uses cookies, pixel systems, and heat-mapping tools to enhance your browsing experience, improve website performance, personalize content, and support essential functionalities. By accessing or using the What About Mkt website, you acknowledge and agree to the use of these technologies as described in our Cookie Policy.

19. Entire Agreement and Severability

These Terms of Use, together with the Privacy Policy, Cookie Policy, and any other policies or legal notices referenced on the Website, constitute the entire agreement between you and What About Mkt regarding your use of the Website and its services.

These Terms supersede any prior agreements, communications, or understandings, whether written or oral, relating to the use of the Website.

If any provision of these Terms of Use is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed from these Terms, and the remaining provisions shall remain in full force and effect.

The invalid or unenforceable provision will be interpreted, to the extent possible, in a manner consistent with applicable law and the original intent of the provision.

Failure by What About Mkt to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
